1. Welcome and Acceptance

Welcome to Joka.ca (the "Site"). This Site provides access to privately hosted applications and services (collectively, the "Services").

These Terms of Service ("Terms") outline the rules for using the Services. The terms "We," "Us," "Our," or "the Administrator" refer to the individual owner and operator of Joka.ca. The terms "You" or "User" refer to you, the person invited to use the Services.

This is a private, personal project. The Services are provided to you as a courtesy and are not for commercial use.

By accessing or using any of the Services, you agree to be bound by these Terms. If you do not agree to these terms, you must stop using the Services immediately.

2. The Services

• "As-Is" Service: The Services are provided strictly "AS IS" and "AS AVAILABLE." They may be modified, interrupted, suspended, or discontinued at any time, for any reason, without notice.
• No Guarantees: We make no promises or guarantees regarding the Services' reliability, security, availability, or performance.
• No Commercial Use: The Services are provided for your personal, non-commercial use only. You may not resell, lease, or use the Services for any business or revenue-generating activity.

3. User Accounts

To use the Services, you may need to be provisioned with an account. You are responsible for:

• Keeping your account credentials (like passwords) confidential.
• All activities that occur under your account, whether or not you authorized them.
• Notifying the Administrator immediately if you suspect any unauthorized use of your account.

4. Acceptable Use Policy

Your use of the Services is conditional. You agree that you will not use the Services to:

• Violate Any Laws: Engage in any activity that is illegal under Canadian or international law.
• Infringe on Rights: Host, upload, or share any content that infringes on the intellectual property rights (copyright, trademark, etc.) or privacy rights of any third party.
• Distribute Harmful Content: Transmit any viruses, malware, or other malicious or disruptive code.
• Abuse Resources: Engage in any activity that places an unreasonable load on the server or network infrastructure. This includes, but is not limited to, spamming, cryptomining, running denial-of-service (DDoS) attacks, or operating public file-sharing services.
• Host Objectionable Content: Host or transmit any content that is defamatory, harassing, abusive, obscene, hateful, or otherwise objectionable.

Violation of this policy may result in the immediate suspension or termination of your account and the removal of your content.

5. Your Content and Data

• You Own Your Content: You retain all ownership rights to the data, files, and information you upload or create on the Services ("Your Content").
• License to Us: By using the Services, you grant the Administrator a limited, worldwide license to host, store, back up, and transmit Your Content solely for the purpose of providing the Services to you.
• Your Responsibility: You are solely responsible for Your Content. You warrant that you have all necessary rights to upload and use Your Content and that it does not violate these Terms.
• NO BACKUP GUARANTEE: You are 100% responsible for maintaining your own backups. Data may be lost or corrupted at any time. We are not liable for any loss or corruption of Your Content. Do not use the Services as your only copy of any important data.

6. Termination

The Administrator reserves the right to suspend or terminate your access to the Services at any time, for any reason or no reason, with or without notice.

This is a personal arrangement. If you breach these Terms, abuse the Services, or if the personal relationship between you and the Administrator ends, your access will be terminated.

Upon termination, your right to use the Services will immediately cease, and the Administrator may permanently delete Your Content from the servers.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS," WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. THE ADMINISTRATOR DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOU USE THE SERVICES AT YOUR OWN SOLE RISK.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE ADMINISTRATOR OF JOKA.CA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

(I) YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICES; (II) ANY CONTENT OR CONDUCT OF ANY THIRD PARTY ON THE SERVICES; (III) ANY OF YOUR CONTENT, INCLUDING ANY LOSS OR CORRUPTION OF YOUR CONTENT; OR (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR ACCOUNT OR CONTENT.

AS THE SERVICES ARE PROVIDED FREE OF CHARGE, YOU AGREE THAT THE ADMINISTRATOR'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM THE SERVICES IS ZERO DOLLARS ($0.00 CAD).

9. Indemnification

You agree to defend, indemnify, and hold harmless the Administrator of Joka.ca from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

• Your access to or use of the Services;
• Your Content; or
• Your violation of these Terms.

(For example, if you host a copyrighted movie and a studio sends a legal notice to the Administrator, you agree to cover the costs.)

10. General Terms

• Governing Law: These Terms shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
• Changes to Terms: We may modify these Terms at any time. We will try to provide notice of significant changes, but it is your responsibility to review them periodically. Your continued use of the Services after changes means you accept the new Terms.

Hi. This is the privacy policy for Joka.ca.

This site is a personal, non-commercial project I (the "Administrator") run to provide services to my friends and invited users ("You"). This policy explains what information I collect, how I use it, and how I protect it.

My goal is to be as transparent as possible. I am not a business, and I will never sell your data.

2. What Information Do I Collect?

I may collect the following information:

• Information You Provide: This includes information you give me to create an account, such as a username, an email address, and a password (which should be stored in a hashed, unreadable format).
• Your Content: This is the data, files, text, or information you upload, create, or store on any of the services I host (e.g., files on a cloud drive, data in an application).
• Technical Information (Server Logs): Like all web servers, mine automatically logs technical information when you use the Services. This may include your IP address, browser type, access times, and what pages you visited.

3. How Do I Use Your Information?

I use this information for only a few simple reasons:

• To Provide the Services: To let you log in, to store your files, and to make the services work.
• To Maintain the Services: To monitor the server for errors, security threats, or performance issues (e.g., to see if a service has crashed).
• To Enforce the Terms: To investigate any potential violations of the Acceptable Use Policy (as outlined in my Terms of Service) or to block abusive traffic.
• To Communicate With You: To email you about important service downtime, maintenance, or any issues with your account.

4. How Do I Share Information? (I Don't)

This is simple:

I will not sell, rent, trade, or share your personal information with any third party for marketing or any other commercial purpose. Period.

The only, very rare exceptions are:

• To Comply with the Law: If I am required by law (e.g., presented with a valid Canadian court order or warrant), I may be forced to disclose information. I will not disclose data unless I am legally compelled to do so.
• To Investigate Abuse: If I have a good faith belief that your activity is violating the Terms of Service (e.g., hosting illegal content or attacking the server), I may investigate and, if necessary, report such activity to the appropriate authorities.

5. Data Security and Administrator Access

• Security: I take reasonable technical measures to secure the server and your data from unauthorized access (e.g., using firewalls, keeping software updated, and using secure protocols). However, no system is 100% secure. You use the Services at your own risk, and I cannot guarantee their absolute security.
• Data Storage Location: Your data is stored on servers I manage, which may be located at my home or with a third-party data center provider [E.G., IN A CANADIAN DATA CENTER].
• ADMINISTRATOR ACCESS: This is important. As the sole administrator, I have the technical ability to access any data on the server, including Your Content. I promise to only use this access when it is absolutely necessary for the reasons listed in Section 3 (like troubleshooting a problem, running a backup, or investigating a security alert). I will not look at your files out of curiosity.

6. Cookies

I use minimal cookies. The services I host almost certainly use "session cookies" to keep you logged in so you don't have to enter your password on every page. I do not use any third-party advertising or tracking cookies.

7. Data Retention & Deletion

I will keep your information as long as you have an account. If you or I terminate your account, I will make a reasonable effort to permanently delete Your Content from the servers.

Server logs (IP addresses, etc.) may be kept for a limited period for security and troubleshooting and are then automatically deleted.

8. Your Rights (Access & Deletion)

You're my friend. You don't need a formal process. If you want to know what information I have about you, or if you want to delete your account and all your data, just ask me. I will do my best to help you quickly.

9. Changes to This Policy

I may update this policy from time to time if I add new services or change how things work. If I make a significant change, I'll probably just email you or tell you directly.
